The data collected with the above-mentioned technologies cannot be used for the identification of the User, and BIO-FUNGI, as the data controller, does not link this data with any other data that may be suitable for identification.

Purpose of data management: The primary purpose of the use of such data is to enable BIO-FUNGI to operate the Website properly, which requires in particular the monitoring of visit data to the Website (compilation of visit statistics) and the prevention of possible misuse of the Website. The BIO-FUNGI website and the information provided there can be accessed by any external visitor. Accordingly, if BIO-FUNGI, as the employer, selected a person from among the candidates for the advertised position, the purpose of the data management was terminated and – according to point d, section (2), § 17 of InfoAct – the personal data of non-selected candidates must be deleted. At the same time, there is an obligation to cancel even if the person concerned changes his / her mind during the application process and withdraws his / her application. In principle, BIO-FUNGI can only keep applications with the express, clear and voluntary consent of the data subject, if the data subject sends his / her application material to BIO-FUNGI, this does not mean that he / she also agrees to employer retain. Therefore, the practice of BIO-FUNGI is to ask for the consent of the applicant, the applicant, after the completion of the selection procedure. Candidates‘ right to information self-determination is guaranteed at the highest level if they are also informed if BIO-FUNGI has not chosen him for the job. The conclusion drawn from the data concerning the data subject is also considered personal data. Accordingly, if an employee of BIO-FUNGI makes any note about the applicant, it will also be considered as personal data of the applicant. On the one hand, this includes the right of the data subject to be informed, ie to find out what conclusions the applicant has drawn in connection with the application material. By submitting the CV, the applicant voluntarily consents to the processing of his / her data in accordance with these regulations.

Legal basis for data management: Pursuant to the GDPR, voluntary consent and § 5 of Act CXII of 2011 on freedom of information and the right to information self-determination.

The scope of the managed data: Name, address, education, and other personal data included in the CV sent at the time of application.

Duration of data management: Until the withdrawal of the applicant’s voluntary consent, but for a maximum of 2 (two) years from the receipt of the CV. Applicants may withdraw their consent to the storage of the CV at any time, at the contact details provided in the data management information and the data protection regulations.

7.2. Management of data of CVs sent by post, e-mail or in person and rules on recruitment

Purpose of data management: BIO-FUNGI provides an opportunity for a prospective employee who receives information about current job offers to submit his / her application to the HR department of the company by mail or in person. The aim of data management is to optimize the number of employees by employing employees with appropriate competencies and expertise.

Legal basis for data management: in the case of a CV sent by post: GDPR and § 6 Act CXII of 2011 on Freedom of Information and the Right to Self-Determination of Information.

In the case of a CV imported in person: GDPR and § 5 of Act CXII of 2011 on Freedom of Information and the Right to Information Self-Determination.

Scope of data processed: personal data contained in the data subject’s curriculum vitae or documents attached to it.

Duration of data management: Until the withdrawal of the applicant’s consent, but for a maximum of 2 (two) years from the receipt of the CV. Applicants may withdraw their consent to the storage of the CV at any time at the contact details provided in the data security and data protection regulations.

8. Data managed through a social site

Purpose of data management: the presentation of BIO-FUNGI’s activities, structure, job opportunities and company-related news on facebook.com.

Legal basis of data management: Act CXII of 2011 on freedom of information and the right to information self-determination. pursuant to § 5 of the TV, the voluntary consent of the person concerned by registering on the facebook.com social site and liking the website.

11. Rights and remedies of the data subject in case of visiting the website, applying for a job advertisement and other voluntary contact

BIO-FUNGI, as the operator and data controller of the website, makes every effort to ensure that personal data is processed in accordance with the law, if you feel that we have not complied with this, please write to us at adatvedelem@biofungi.hu.

In general, the data subject may request from the controller in particular: (a) to be informed of the processing of his or her personal data, (b) to rectify his or her personal data, and (c) to delete or block his or her personal data, with the exception of mandatory data processing. The data controller is obliged to provide the information in writing in a comprehensible form at the request of the data subject as soon as possible after the submission of the request, but no later than within 25 (twenty-five) days.

If the data controller does not comply with the data subject’s request for rectification, blocking or deletion, he / she shall communicate the factual and legal reasons for rejecting the request for rectification, blocking or deletion in writing or with the consent of the data subject within 25 (twenty-five) days of receipt of the request.

The legal basis of the data management is the voluntary consent of the Users, which is given by opening the website and accessing certain parts related to registration.

b.) Right of rectification, cancellation, blocking

If the personal data does not correspond to reality and the personal data corresponding to reality is available to the data controller, the personal data shall be corrected by the data controller. Otherwise, personal data must be deleted if its processing is unlawful; the data subject requests as set out above; incomplete or incorrect – and this condition cannot be legally remedied – provided that cancellation is not precluded by law; the purpose of data processing has ceased or the term for storage of data specified by law has expired; it has been ordered by a court or the Authority.

Instead of erasure, the controller shall block the personal data if the data subject so requests or if, on the basis of the information available to him or her, it can be presumed that the erasure would harm the data subject’s legitimate interests. Personal data blocked in this way may only be processed for as long as the purpose of the data processing, which precluded the deletion of personal data, exists. The controller shall indicate the personal data processed by him or her if the data subject disputes their correctness or accuracy, but the inaccuracy or inaccuracy of the disputed personal data cannot be clearly established.

The rectification, blocking, marking and erasure shall be notified to the data subject and to all persons to whom the data have previously been transmitted for data processing purposes. The notification may be omitted if it does not harm the legitimate interests of the data subject in view of the purpose of the processing.

c.) Right to protest

The data subject may object to the processing of his or her personal data if the processing or transfer of personal data is necessary only for the fulfillment of a legal obligation to the controller or for the legitimate interest of the controller, recipient or third party, except in the case of mandatory processing; if the use or transfer of personal data is for the purpose of direct business acquisition, public opinion polling or scientific research; and in other cases specified by law.
